TERMS & CONDITIONS – STUDENTAN Last Updated: February 18th, 2025 Welcome to Studentan! These Terms of Service (“Terms”) govern your access to and use of the Studentan platform, including our AI-powered educational tools, applications, digital content, and associated services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, you must not use Studentan. Studentan is operated by Junesco Evaluation, Conseil et Formation SA, located at Optingenstrasse 53, 3013 Bern, Switzerland (UID: CHE-470.633.968). 1. Definitions “Studentan” refers to the AI-powered educational platform and its associated services, owned and operated by Junesco Evaluation, Conseil et Formation SA. “User”, “You”, or “Your” refers to any individual or institution accessing or using the Service. “Content” includes any text, data, graphics, audio, video, or other material made available through the Service. “Account” refers to a registered user profile on Studentan. 2. Eligibility You must be at least 13 years old to use Studentan. Users under 13 must have verifiable parental or guardian consent. If you create an account on behalf of a minor, you assume full responsibility for the minor’s use of the Service. 3. User Accounts You agree to: • provide accurate and complete registration information • keep your login credentials secure • not share your account access with others • notify us immediately of any unauthorized access Studentan is not responsible for account misuse resulting from your failure to protect your credentials. 4. Privacy & Data Protection 4.1 Compliance Studentan complies with GDPR, Swiss FADP, CCPA, and other relevant privacy regulations. We process personal data lawfully, transparently, and for legitimate purposes only. We do not sell personal data. 4.2 Data Collected We may collect: • Account and profile information • Learning activity, tool usage, and progress • Device, IP, browser, and interaction data • Technical logs for platform performance and security 4.3 Data Usage Your data is processed to: • provide and improve the Service • personalize learning experiences • ensure system security and legal compliance 4.4 Data Storage & Rights Data is stored securely with encryption and access limits. Intellectual Property Studentan’s software, design, branding, features, AI tools, and all original content are owned or licensed by Junesco Evaluation, Conseil et Formation SA. You may not copy, distribute, modify, or resell any part of the Service without explicit written permission. User-submitted content grants Studentan a non-exclusive, royalty-free license to store, process, and improve our AI models on an aggregated and anonymized basis. 6. Acceptable Use Policy You agree not to: • use Studentan for cheating or academic dishonesty • exploit, reverse-engineer, or interfere with the AI system • upload harmful, illegal, or offensive material • impersonate others or misrepresent information • attempt to bypass usage limits or token consumption rules Violations may lead to immediate suspension or termination of your account. 7. AI Limitations & Disclaimer Studentan uses artificial intelligence to assist learning but does not replace educators or official academic resources. AI-generated content may contain inaccuracies or biases. Users must verify critical information. Studentan is not liable for: • errors in AI output • misunderstandings or misuse of AI-generated content • outcomes resulting from reliance on suggestions or explanations produced by the AI 8. Payment & Subscription Terms Certain features require a paid subscription. Current pricing is displayed on our website or promotional pages. Subscriptions renew automatically unless cancelled before the renewal date. Cancelling prevents future charges but does not refund the current period. Access to paid features remains active until the end of the billing cycle. 9. Payment, Refund, and No-Refund Policy 9.1 General Rule All payments made on Studentan are final and non-refundable. By purchasing any subscription, credits, or digital goods, you expressly agree to this policy. 9.2 Digital Goods & Instant Access Studentan provides immediate access to digital services, including AI credits, templates, audio generation, and more. Because access is instant, the user waives any right of withdrawal or refund once the product is delivered. 9.3 AI Tokens & Credit Consumption Studentan operates on a token-based consumption model. Once credits or tokens are allocated to your account, they are considered fully delivered and cannot be refunded, reversed, or exchanged. 9.4 Subscription Payments • Cancelling a subscription stops future renewals. • The current billing period is always non-refundable, regardless of usage. • Promotional offers, coupons, and Black Friday deals are also non-refundable. 9.5 User Errors Refunds are not granted for: • accidental purchases • subscription renewals forgotten • misunderstandings of features • failure to use the service 9.6 Technical Issues While we will do everything possible to resolve technical problems, such issues do not justify refunds unless the platform is entirely unusable, verified by our team, and the cause is directly attributable to Studentan. 9.7 Chargebacks Chargeback attempts may lead to: • account suspension • loss of access to all credits and features • submission of evidence demonstrating service delivery • legal and administrative expenses 9.8 Legal Exceptions If applicable consumer protection law requires a refund, the refund will be granted strictly within the limits of these laws. In all other cases, the No Refund Policy applies fully. 10. Limitation of Liability Studentan provides the Service “as is,” without warranties regarding accuracy, availability, or suitability. The platform is not responsible for: • direct or indirect damages • loss of data • service interruptions • educational outcomes • reliance on AI-generated material Maximum liability is limited to the amount paid by the user in the last 12 months. 11. Termination Accounts may be suspended or terminated for violations of these Terms. You may delete your account at any time. The following survive termination: • Privacy obligations • Intellectual property rights • No Refund Policy • Limitation of liability • Governing law and jurisdiction 12. Governing Law & Dispute Resolution These Terms are governed exclusively by Swiss law. All disputes arising out of or related to these Terms fall under the exclusive jurisdiction of the competent courts of Berne, Switzerland. 13. Updates to These Terms We may update these Terms at any time. Significant updates will be communicated via email or platform notification. Continued use of Studentan constitutes acceptance of the updated Terms. 14.
